Surry County General District Court

The Surry County General District Court handles traffic violations, misdemeanor criminal charges, civil claims up to $25,000, and preliminary hearings for felony cases. It operates within the 6th Judicial District. Small claims under $5,000 are also handled here. Types of Records at Surry County Circuit Court

The Surry County Circuit Court Clerk holds civil case files, felony criminal records, probate documents, family law filings, and land records. Probate records include wills, estate inventories, letters of administration, and orders related to estate settlement. Land records such as deeds and deeds of trust are filed with the Clerk. Criminal case files at the circuit court level contain charging documents, indictments, plea agreements, and sentencing orders. Trial transcripts are part of the record when a case goes to jury. Most circuit court records in Surry County are public under Va. Code § 17.1-208. Sealed cases, juvenile court files, and adoption records are not available to the public. Financial documents submitted under a protective order in civil litigation may also be restricted.

General district court records are public as well. They cover traffic and misdemeanor cases along with small civil disputes. These files are managed by the district court clerk and are separate from circuit court records.

Getting Copies of Surry County Court Records

Plain copies of Surry County court records cost $0.50 per page. Certified copies add $2.00 per document. Triple-seal copies, used for some legal purposes outside Virginia, cost an additional $2.50 per document. These fees apply to records at the circuit court level. The district court may have different fee structures for copies of its own records.

For in-person copy requests, go to the Surry County Courthouse during office hours and give the clerk the case information. Staff will locate the file and make copies on request. Public Access and Virginia FOIA
