Suffolk Circuit Court

The Suffolk Circuit Court is part of the 5th Judicial Circuit of Virginia. The court has jurisdiction over civil cases above $4,500, all felony criminal charges filed within the city, divorce and family law matters, and appeals from General District Court. The Clerk of Circuit Court is the official keeper of all civil, criminal, land, probate, and marriage records for cases arising within Suffolk city limits. Because Suffolk is an independent city, it has no connection to any surrounding county for court purposes.

Suffolk is the largest city in Virginia by geographic size, which means the court serves a sprawling area. The 5th Judicial District for district court purposes covers Suffolk along with Franklin City, Isle of Wight County, and Southampton County. The circuit and district courts have separate jurisdiction structures, so the courts that serve Suffolk at the circuit level are defined by the 5th Judicial Circuit. If you are filing a case or looking up a record, confirm whether you need the circuit court or the district court before you contact the office.

Types of Court Records in Suffolk

Suffolk court records cover a broad range of civil, criminal, and family law matters. Circuit court files are the most complete. A civil case file holds the original complaint, motions, exhibits admitted into evidence, court orders, and the final judgment or decree. Criminal case files contain the charging document, plea records, sentencing orders, and any conditions of probation or parole. Family law files include divorce decrees, property settlements, custody orders, and child or spousal support orders.

District court records cover traffic violations, misdemeanor charges, smaller civil suits, and protective orders. These are generally public records. Juvenile and Domestic Relations Court records are confidential under Virginia law and cannot be viewed by the general public regardless of the case outcome.

Land records, deeds, mortgages, liens, and plats for property within Suffolk city limits are maintained by the Circuit Court Clerk. Marriage licenses issued in Suffolk are also part of the permanent clerk records. Wills and probate files are kept by the clerk's office and can be searched during regular business hours. Some of these records go back many decades, reflecting Suffolk's long history as an agricultural and commercial center in southeastern Virginia.

Copies and Fees

Plain copies of court records cost $0.50 per page. Certified copies add $2.00 per document. Triple-seal copies, which require both the Clerk's and a judge's signatures plus the official court seal, carry an additional $2.50 charge on top of the per-page fee. These rates apply uniformly across all Virginia circuit courts under state law.

You can request copies in person at 150 North Main Street, or by mail. Mail requests should include the names of all parties, the case number, a description of the document needed, and payment by check or money order made out to the Clerk of Circuit Court. If you are unsure of the total cost, call (757) 514-4800 before you send payment. In-person requests for current records are often processed the same day. Older records may need time to retrieve if they are stored off-site.

Note: Land record copies carry the same per-page rate. If you are doing a title search or pulling multiple records, ask the clerk about the most efficient way to access them. Some older land record data may be available for viewing at no cost before ordering physical copies.

Public Access and FOIA in Suffolk

Suffolk court records are public under Virginia Code ยง 2.2-3700, the Virginia Freedom of Information Act. Virginia residents have the right to inspect and copy public court records during normal business hours. You do not need to give a reason for your request in most cases, and you do not need to file a formal FOIA request just to view records that are not restricted.

For a formal FOIA request, contact the clerk's office and describe specifically what records you need. Include party names, approximate dates, and the type of document. The office must respond within five business days. If the request is large, they may ask for more time. Records that are sealed by court order, records involving juveniles, adoption files, and mental health proceedings are not available to the public even under FOIA. The National Freedom of Information Coalition has a useful plain-language summary of Virginia's open records rules for anyone who wants more background on their rights.

The Suffolk Circuit Court page on the Virginia Judicial System website lists current clerk contact information, courthouse details, and links to the statewide case information system for the 5th Judicial Circuit.
