Find Court Records in Roanoke

Roanoke court records are maintained by the Clerk of Circuit Court and the General District Court for the City of Roanoke, an independent city in southwestern Virginia with its own full court system. The City of Roanoke is not the same as Roanoke County. These are two separate jurisdictions with separate clerks, separate case systems, and separate court facilities. If you need to look up a case, get a certified copy, or check a docket, this page covers where to go and how the records system works for city cases filed under the 23rd Judicial Circuit.

Roanoke City Circuit Court

The Roanoke City Circuit Court operates under the 23rd Judicial Circuit of Virginia. This court has jurisdiction over civil cases exceeding $4,500, all felony criminal charges, divorce and custody matters, and appeals from General District Court. The Clerk of Circuit Court maintains all civil, criminal, land, probate, and marriage records for cases filed within Roanoke city limits. Because the city and the county share the same name, it is common for people to contact the wrong office. Make sure you know which jurisdiction your case falls under before you call or visit.

The 23rd Judicial Circuit includes the City of Roanoke, Roanoke County, and the City of Salem. All three have separate court systems, but they share the same judicial circuit. Judges rotate among these jurisdictions. The Clerk's offices, however, are completely separate. Roanoke City cases are handled at the Roanoke City Courthouse, not at the Roanoke County courthouse in Salem.

Types of Court Records in Roanoke

Roanoke City court records include a wide range of case types. Circuit court records are the most detailed. Civil case files contain the original complaint, motions, court orders, and the final judgment or settlement. Criminal case files hold the charging document, plea records, sentencing orders, and any conditions of probation or suspended sentence. Family law files may include divorce decrees, custody and visitation orders, child and spousal support rulings, and any modifications filed over time.

District court records cover traffic cases, misdemeanor charges, smaller civil suits, and protective orders. These are generally public records unless sealed by a judge. Juvenile and Domestic Relations Court records are confidential under state law and are not available to the public regardless of the case type.

Land records, deeds, mortgages, and liens filed in Roanoke City are maintained by the Circuit Court Clerk. Marriage licenses issued in the city are also part of the clerk's permanent collection. Wills and probate files are similarly maintained in the clerk's office and can be searched in person during office hours.

Standard copies of court records cost $0.50 per page. Certified copies add $2.00 per document. If you need a triple-seal copy, which includes signatures from both the Clerk and a judge plus the court seal, the extra charge is $2.50 on top of the per-page rate. These are Virginia state fees that apply uniformly at all circuit courts.

You can request copies in person at the Clerk's office at 315 West Church Avenue SW. Mail requests are also accepted. Include the names of parties, the case number if known, the type of document, and payment by check or money order payable to the Clerk of Circuit Court. Call (540) 853-2361 ahead of time if you are unsure of the total cost. In-person requests are usually handled the same day for current records.
